Damage Liability & Rental Agreement

DAMAGE LIABILITY & RENTAL AGREEMENT This Rental Agreement ("Agreement") is entered into between Elite Premiere Events ("Company") and the customer identified below ("Renter"). 1. ACCEPTANCE OF RESPONSIBILITY By signing this Agreement, the Renter accepts full and sole responsibility for all rented equipment from the time of delivery or pickup until the time of return or pickup by Elite Premiere Events. The Renter agrees to use all equipment in a safe and appropriate manner. 2. DAMAGE & LOSS The Renter agrees to pay for any and all damage, loss, theft, or destruction of rented equipment during the rental period. This includes, but is not limited to: broken, bent, torn, stained, or otherwise damaged items; missing items not returned at the end of the rental period; and items returned in a condition other than that in which they were delivered. 3. REPLACEMENT & REPAIR FEES In the event of damage or loss, Elite Premiere Events reserves the right to charge the Renter the full replacement cost or repair cost of the affected item(s), at the Company's sole discretion. The Renter authorizes Elite Premiere Events to charge any payment method on file for such amounts. 4. SETUP & BREAKDOWN Unless a setup service has been explicitly arranged and confirmed in writing with Elite Premiere Events, the Renter is solely responsible for the setup, use, and breakdown of all rented equipment. Elite Premiere Events is not liable for injuries or property damage resulting from improper setup or use by the Renter or their guests. 5. WEATHER & FORCE MAJEURE The Renter acknowledges that outdoor events carry inherent weather risks. Elite Premiere Events is not responsible for damage caused by wind, rain, or other weather events once equipment has been delivered. The Renter assumes all risk for weather-related damage. 6. INDEMNIFICATION The Renter agrees to indemnify, defend, and hold harmless Elite Premiere Events, its owners, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to the Renter's use of the rented equipment. 7. GOVERNING LAW This Agreement shall be governed by the laws of the State of Arizona. Any disputes arising under this Agreement shall be resolved in Maricopa County, Arizona. 8. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations, or agreements. By signing below, the Renter acknowledges that they have read, understood, and agree to all terms and conditions set forth in this Agreement.
